We plan to appeal Wednesday’s Board of Adjustment decision to the City Council as soon as possible.
December 8, the City Council will be voting on proposed revisions to the city’s appeals ordinance. These revisions affect our ability to appeal antenna and tower approvals. Constitutional questions were raised about the public’s right to due process, because the NEW ORDINANCE would do things like ELIMINATE THE RIGHT TO APPEAL LAND USE DECISIONS TO THE CITY COUNCIL. It would also have final decisions on some appeals made by the City Attorney without a hearing, which might be a violation of state law.
DECEMBER 8, the continued discussion and vote will take place during the evening session, and I believe any person may speak about this during “Petitions From the Floor” which will take place first, at 7 p.m.
This proposal will reduce the time for appeal from 30 days to 15 days; the reduction in time could effectively make it impossible for the public to appeal these decisions.
FOR THOSE FIGHTING THE 3 NEW TOWERS: The three new tower applications (at Solana Center, Baillios and Fort Marcy Park) have still not been filed with the city, but AT&T can file them at any time.
MY SUSPICION IS THAT THEY WILL REAPPLY DURING THE HOLIDAYS, ASSUMING THAT WE WILL NOT FIGHT BACK. DON’T MAKE THIS TRUE, PLEASE!!!!!!!!!!
